Terms and Conditions 

Competition Period: 4 May 2026 – 17 May 2026 

Winner Announced: 18 May 2026 via @purecherryjuice on Instagram 


1. The Promoter 

The Giveaway (as defined below) is promoted by CherryHill Orchards ABN 62 653 630 365 of 474 Queens Rd, Wandin East, 3139, Victoria, Australia (the "Promoter"). For any queries regarding this Giveaway, please contact the Promoter via email at info@cherryhill.com.au. 

2. The Giveaway 

The CherryHill Orchards Pure Cherry Juice Giveaway (the "Giveaway") is a promotional competition conducted by the Promoter to support the launch of its Pure Cherry Juice product range and website (www.purecherryjuice.com.au) and to grow its Instagram community (@purecherryjuice). 

The Giveaway is not a game of chance. Entry is free and requires only the steps set out in clause 5 below. No purchase is necessary to enter. 

3. Eligibility 

To be eligible to enter the Giveaway, participants must: 

  • Be a resident of Australia; 
  • Be 18 years of age or older at the time of entry; 
  • Not be an employee, director, officer, contractor, agent, or immediate family member of an employee of the Promoter or any person involved in the administration of this Giveaway; 
  • Have a valid, personal Instagram account, a valid email address and a valid Australian phone number; 
  • Comply with Instagram's Terms of Use (https://www.instagram.com/about/legal/terms/) at all times; and 
  • Comply with all conditions set out in these Terms and Conditions. 

The Promoter reserves the right to verify the eligibility of any entrant and to disqualify any entrant who does not satisfy the eligibility criteria. 

4. Competition Period 

The Giveaway opens at 5:00 PM Australian Eastern Standard Time (AEST) on Monday, 4 May 2026 ("Opening Date") and closes at 11:59 PM AEST on Sunday, 17 May 2026 ("Closing Date"). Entries received outside this period will not be accepted. 

The Promoter reserves the right to extend, shorten, suspend, or terminate the Giveaway at any time with reasonable notice, subject to any relevant regulatory requirements. 

5. How to Enter 

To enter the Giveaway, eligible participants must complete BOTH of the following steps during the Competition Period: 

  • Subscribe to the CherryHill Orchards Pure Cherry Juice mailing list by completing the sign-up form at www.purecherryjuice.com.au (with valid Australian phone number and valid email address); AND 
  • Follow the @purecherryjuice Instagram account at https://www.instagram.com/purecherryjuice/. 

Both entry steps must be completed by 11:59 PM AEST on 17 May 2026 to constitute a valid entry. Each eligible participant may only enter once. Duplicate entries (e.g., from multiple email addresses or Instagram accounts belonging to the same person) will be disqualified. 

Automated, bulk, or third-party entries are not permitted and will be disqualified. 

6. The Prize 

There is ONE (1) prize available in this Giveaway. The prize is: 

  • One (1) $500 VISA or Mastercard Gift Card 

The prize has an estimated total retail value ("ERTV") of AUD $500.00 The ERTV is accurate as at the date of publication of these Terms and Conditions. The Promoter accepts no responsibility for any variation in the value of the prize. 

The prize is not transferable, exchangeable, or redeemable for cash or any other product or service, except at the absolute discretion of the Promoter. If the specified prize or any component of it is unavailable, the Promoter may, at its discretion, substitute a prize of equal or greater value. 

Where applicable, the winner is responsible for all costs and expenses associated with accepting and using the prize not expressly stated as being included (including any applicable taxes). The Promoter will not be liable for any tax implications arising from the winner receiving the prize. Independent financial advice should be sought where necessary. 

7. Winner Selection & Notification 

7.1 Selection 

One (1) winner will be selected at random by the Promoter from all valid entries received during the Competition Period. The draw will take place on or about 18 May 2026 at 474 Queens Rd, Wandin East, 3139, Victoria Australia. The draw will be conducted by a computerised random selection process. 

The Promoter may conduct additional draws to select reserve winner(s) in the event a selected winner is ineligible, cannot be contacted within the notification period, or declines the prize. 

7.2 Notification 

The winner will be notified by: 

  • A public announcement via the @purecherryjuice Instagram account on 18 May 2026; and 
  • A direct email to the email address provided by the winner at the time of mailing list subscription. 

If the winner does not respond to the notification email within seven (7) days of the date the notification is sent, the Promoter reserves the right to redraw and select an alternative winner. The Promoter's attempts to notify the winner are final. 

7.3 Prize Delivery 

The Promoter will contact the winner directly via email to arrange delivery of the prize. The Promoter will not be liable for any loss, damage, or delay in delivery of the prize once it has been dispatched. 

8. Publication of Winner 

By entering the Giveaway, entrants consent to their Instagram username being published on the @purecherryjuice Instagram account as part of the winner announcement. The winner's full name and/or suburb may also be published in accordance with the Gambling Regulation Act 2003 (Vic) and related instruments. No other personally identifiable information will be published without the winner's separate consent. 

9. Conditions of Entry 

By entering the Giveaway, entrants agree: 

  1. To be bound by these Terms and Conditions and any instructions given by the Promoter;
  2. That the Promoter may use their Instagram username, name, and state/territory of residence for promotional, marketing, and publicity purposes in any media (including social media) worldwide and without further compensation, unless prohibited by law;
  3. That entry into the Giveaway is voluntary and free of charge;
  4. That the Promoter's decisions in relation to all aspects of this Giveaway are final and no correspondence will be entered into;
  5. That they will not engage in any conduct that is fraudulent, misleading, deceptive, or otherwise damaging to the Giveaway or the Promoter's reputation; and
  6. That they comply with Instagram's Community Guidelines and Terms of Use at all times. 

10. Privacy & Data Collection 

The Promoter collects personal information (including name and email address) from entrants for the purpose of administering the Giveaway, contacting the winner, and sending marketing communications from CherryHill Orchards. 

The Promoter handles personal information in accordance with its Privacy Policy (available at www.purecherryjuice.com.au/privacy) and the Privacy Act 1988 (Cth) (as amended by the Privacy Amendment (Enhancing Privacy Protection) Act 2012), including the Australian Privacy Principles. 

Entrants have the right to access and correct their personal information held by the Promoter. Please contact info@cherryhill.com.au for privacy-related enquiries. 

Subscribing to the mailing list as a condition of entry means the Promoter will add entrants to its marketing communications list. Entrants may unsubscribe at any time by clicking the unsubscribe link in any email or contacting the Promoter directly. 

This Giveaway is in no way sponsored, endorsed, or administered by, or associated with, Instagram or Meta Platforms, Inc. Instagram/Meta bears no responsibility for this Giveaway. Any questions, comments, or complaints regarding the Giveaway should be directed to the Promoter, not to Instagram/Meta. 

11. Conduct & Disqualification 

The Promoter reserves the right, at any time and in its sole discretion, to: 

  • Verify the validity of entries and any entrant's identity, age, and eligibility; 
  • Disqualify any entrant who tampers with the entry process, acts dishonestly, or breaches these Terms and Conditions; 
  • Disqualify entries that are incomplete, incomprehensible, offensive, or otherwise inappropriate; 
  • Disqualify entries that involve the use of automated software, bots, or other artificial means; and 
  • Cancel, terminate, modify, or suspend the Giveaway if it determines (in its sole discretion) that the Giveaway cannot be conducted as planned due to technical failures, unauthorised intervention, fraud, or any other cause beyond the Promoter's reasonable control. 

If the Giveaway is cancelled or modified, the Promoter will notify entrants as soon as reasonably practicable via the @purecherryjuice Instagram account. 

12. Limitation of Liability 

To the maximum extent permitted by law, the Promoter and its related bodies corporate, officers, employees, agents, and contractors will not be liable for any loss, damage (including consequential or indirect loss), injury, cost, or expense suffered or incurred in connection with: 

  • Participation in the Giveaway or acceptance and/or use of the prize; 
  • Any delay, technical malfunction, error, omission, interruption, or unavailability of any network, system, or platform (including Instagram) used in connection with the Giveaway; or 
  • Any act or omission by a third party in connection with the Giveaway. 

Nothing in these Terms and Conditions excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded, restricted, or modified under applicable law, including the Australian Consumer Law. 

13. Governing Law & Jurisdiction 

This Giveaway and these Terms and Conditions are governed by the laws of the State of Victoria, Australia. Each entrant submits to the non-exclusive jurisdiction of the courts of Victoria and the Federal Courts of Australia in relation to any dispute arising in connection with this Giveaway. 

This Giveaway is conducted in accordance with the Gambling Regulation Act 2003 (Vic). [NOTE: If the prize value exceeds AUD $5,000, the Promoter may be required to hold a Trade Promotion Lottery permit under Victorian law. Please confirm prize value and consult a legal adviser regarding permit requirements.] 

14. General 

These Terms and Conditions constitute the entire agreement between the Promoter and entrants in relation to the Giveaway. If any provision of these Terms and Conditions is unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect. 

The Promoter's failure to enforce any provision of these Terms and Conditions will not be deemed a waiver of that provision.
